About these terms
These terms apply to retainos.co and to RetainOS, a service operated by 305LocalConnect, a Florida business ("RetainOS," "we," "us"). By using the website or our services, you agree to them. If you sign a separate agreement or order form with us, that agreement controls where it differs from these terms.
Our services
RetainOS is a done-for-you client retention service for local businesses: online booking, reminders, loyalty and referral programs, complimentary rewards and review requests, in English and Spanish. Features depend on the plan chosen. Prices, offers and timelines on the website are subject to confirmation in your order.
Text message program
Program: RetainOS text messages.
Who gets messages: business owners who request information or sign up with RetainOS receive messages about their request, onboarding, appointments and service updates. Clients of businesses using RetainOS receive messages from that business, such as visit reminders, reward notices, referral invitations and review requests.
Frequency: message frequency varies. Cost: message and data rates may apply.
Opt out: reply STOP to any message to cancel. You'll get one message confirming you're unsubscribed. Help: reply HELP, or use our contact page.
Consent to receive texts is not a condition of any purchase. Carriers are not liable for delayed or undelivered messages.
Business customer responsibilities
If you use RetainOS for your business, you agree to:
- Give us accurate information and keep it up to date.
- Only add clients who have given you permission to contact them by text and email, and honor opt-outs.
- Follow the laws that apply to your business and your messages, including telemarketing, anti-spam and consumer protection rules.
- Not ask us to send anything false, misleading, offensive or illegal.
Reviews
Every client gets the same simple request for an honest review. Rewards are never given for reviews, and reviews are never filtered by how positive they are.
Rewards
Rewards are complimentary and fulfilled by a third-party rewards partner. They are not cash or gift cards and can't be sold or exchanged for cash. Each reward comes with its own terms, which are final. RetainOS is not a travel agency and doesn't own hotels or restaurants. Full details are on our rewards page.
No medical advice
RetainOS does not provide medical advice, clinical services or patient care, and does not decide which patients a practice should contact or treat.
Fees and cancellation
Fees, setup costs, billing dates and cancellation terms are set in your order or agreement. Payments are processed by our payment processor. Setup fees are waived only where an offer says so.
Ownership
The website, the RetainOS name, logos and content belong to us. Your business and client data stay yours; you give us permission to use them only to provide the service.
No guarantees
We work hard to bring clients back, but we can't guarantee specific results, revenue or bookings. The website and services are provided "as is" and "as available" to the extent the law allows.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or lost profits. Our total liability for any claim is limited to the fees you paid us in the three months before the claim, or $100 if you haven't paid us anything.
Business customers agree to cover claims that come from their own messages, client lists or breaking these terms.
Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida.
If we offer these terms in Spanish, the English version controls if the two differ.
Changes
We may update these terms. The date at the top shows the latest version. Using the website or services after a change means you accept the updated terms.
